Simply put, if you’re not in Spain or don’t have the time to handle the tedious procedures of buying a house yourself, you can legally authorize your lawyer to act on your behalf. From applying for an NIE and opening a bank account to signing reservation contracts and even the final deed of sale at the notary, your lawyer can handle it all. It truly saves a tremendous amount of time and effort.

Why you need it, and what can a [lawyer for buying property in Spain] be authorized to do?
Why is this authorization necessary? Because the process of buying property in Spain involves many interconnected steps, a lot of which require you to be physically present to sign documents. If you’re a tourist or working in your home country, flying to Spain for every single step is impractical. This is where a valid power of attorney becomes essential. Typically, this authorization will include the power to: apply for a tax identification number (NIE), open a bank account and manage funds for the property purchase, sign all property-related contracts, pay associated taxes and fees, handle property registration, and manage the transfer of utilities like water, electricity, and gas. Basically, apart from choosing the property itself, all other legal and administrative procedures can be delegated to your lawyer.
Key Point: Special vs. General Power of Attorney
It’s crucial to note when hiring a lawyer for property purchase in Spain that there are two types of power of attorney: one is a Poder Especial (Special Power of Attorney), and the other is a Poder General (General Power of Attorney). A general power of attorney grants extremely broad powers, almost equivalent to handing over all your civil rights, which is highly risky and strongly discouraged! For a property purchase, you must always opt for a Special Power of Attorney. This document will explicitly state that the sole purpose of the authorization is for the purchase of a specific property at a certain address, and you can even set a maximum transaction price. This confines the lawyer’s authority strictly to this particular real estate transaction, ensuring the safety of your funds and assets.
