I’ve seen a lot of friends on the forums talking about buying property lately, and it’s getting me excited too. But the thought of all the different taxes here in Spain can be overwhelming. When buying a home in Spain, the biggest distinction is whether you’re purchasing a new build or a resale property. The main taxes involved are completely different for each.
New Property Taxes
If you’re buying a brand-new home directly from a developer, there are two main taxes:
- IVA (Value Added Tax): This is a national tax with a fixed rate. For standard residential properties, the IVA is 10%. If the property is government-subsidized housing (Vivienda de Protección Oficial), the rate is lower, typically 4%. This tax, part of the overall Spanish property purchase tax, is paid to the seller in addition to the property price.
- AJD (Stamp Duty): The full name is Actos Jurídicos Documentados. This is a regional tax managed by each autonomous community, so the rate varies, typically ranging from 0.5% to 1.5%. For example, it’s 1.2% in Andalusia and 1.5% in Catalonia.
Resale Property Taxes
If you’re buying a resale property, you don’t pay IVA. Instead, you’ll face another major tax:
ITP (Property Transfer Tax): The full name is Impuesto sobre Transmisiones Patrimoniales. This tax is also levied by each autonomous community, and its rate is much higher than AJD, generally between 6% and 10%. For example, it’s 6% in the Community of Madrid and 10% in the Valencian Community. The buyer is responsible for declaring and paying this tax to the tax office. For resale properties, ITP is the single largest tax expense.

Other Common Costs
Whether you’re buying a new or resale property, in addition to the main taxes, there are several other unavoidable fees. While they might seem small individually, they add up.
