Main Tax Types: New-Build vs. Resale Properties
In Spain, the most critical factor determining the taxes you’ll pay is whether you’re purchasing a new-build or a resale property, as this dictates the type of primary tax and the rates differ significantly.
If You’re Buying a Resale Property
The primary tax for a resale property, a key component of the overall Spanish property taxes, is the Property Transfer Tax, known in Spanish as Impuesto de Transmisiones Patrimoniales or ITP. In Catalonia, the region where Barcelona is located, this tax has a progressive rate, but for most average buyers, you can simply calculate it as 10% of the property price. For example, for a €300,000 home, the ITP would be €30,000. Of course, there are reduced rates; for instance, the rate can drop to 5% if you are under 32 years old and meet certain income requirements, or if you are purchasing a government-subsidized home (VPO).
If You’re Buying a New-Build Property
If you buy a new-build property, you don’t pay ITP. Instead, you’ll pay two different taxes:
- Value Added Tax (VAT): In Spanish, Impuesto sobre el Valor Añadido (IVA). For residential properties, this is a fixed rate of 10%.
- Stamp Duty: The full name is Actos Jurídicos Documentados (AJD). This tax is paid in addition to VAT. In Catalonia, the rate is 1.5%.
So, the total tax rate for a new-build property is 10% + 1.5% = 11.5%. Using the same €300,000 property as an example, the taxes for a new-build would amount to €34,500, which is slightly higher than for a resale property.
