First, the most crucial point to clarify is whether you’re buying a new build or a resale property in Spain. The type of tax and the tax rate are completely different for these two categories. Simply put, you pay VAT on new builds and a Property Transfer Tax on resale homes. These two taxes are mutually exclusive; if you pay IVA, you don’t pay ITP, and vice versa. It’s essential not to mix them up!
VAT (IVA) on New Builds
If you’re buying a brand-new property directly from a developer, you’ll need to pay IVA (Value Added Tax). On the Spanish mainland and the Balearic Islands, this rate is typically a fixed 10%. For example, on a new €300,000 home, the IVA would be €30,000. There’s an exception in the Canary Islands, where they have a different tax called IGIC, with a rate of 7%. In addition to the Spanish property VAT, buying a new build usually involves another cost: Stamp Duty (AJD). This rate varies by region, typically ranging from 0.5% to 1.5%. It’s a significant expense, so be sure to factor it into your total cost!
Property Transfer Tax (ITP) on Resale Homes
If the property you’re buying is a resale, congratulations—you don’t have to pay IVA! Instead, you’ll pay ITP (Impuesto de Transmisiones Patrimoniales). This part of the Spanish property purchase taxes is more complex than IVA because its rate isn’t uniform across the country; it’s determined by each autonomous community’s government. The rates generally range from 6% to 10%, which is a huge difference. Therefore, you must check the specific ITP rate for the region where your desired property is located.
