I’ve finally settled down here in Madrid, and the process has been a real rollercoaster of emotions. From viewing properties to the final signing, every step felt like a new challenge. The most confusing and tricky part was definitely the taxes. The information online is a mess, but after a lot of research, I’ve finally got it all straight. Today, I’m sharing what I learned to help anyone who is currently buying or planning to buy a home.

First Step: Know the Difference Between New-Build and Resale Homes
In Spain, the type and amount of tax you pay when buying a home depend on whether it’s a new-build or a resale property. The main taxes for these two are completely different, so it’s crucial not to mix them up. Simply put, a new-build is a property bought directly from a developer for the first time, while a resale home is purchased from a private owner.
- Buying a New-Build Home: The main tax is IVA (VAT). The current rate in most regions is 10%. In addition, there’s another tax called AJD (Stamp Duty), with rates varying between 0.5% and 1.5% depending on the autonomous community. So, the total tax for a new-build is around 11.5%.
- Buying a Resale Home: The main tax is ITP (Property Transfer Tax). This tax is paid to the regional government, and the rate varies by region, typically ranging from 6% to 10%. For example, it’s 6% in Madrid and 10% in Catalonia. If you pay ITP, you don’t have to pay IVA and AJD.
How Are the Taxes Paid? What’s the Process?
Once you know which tax you need to pay, the next step is how to pay it. Generally, you don’t have to handle this yourself. Your lawyer or the Gestoría (administrative agency) managing the paperwork will take care of everything. After you sign the official purchase deed at the notary’s office, the tax declaration and payment process begins. You’ll need to have the tax money ready and transfer it to your Gestoría, who will then file the return and pay the tax office on your behalf.

It’s crucial to note that there’s a deadline for paying the tax. You typically have 30 working days from the date of signing the purchase deed to complete the payment. This timeframe is very important, as missing the deadline will result in fines and late payment interest. So, make sure to confirm the timeline with your representative and ensure the funds are available on time.
Finally, a reminder: don’t forget to include the significant cost of taxes in your budget! For example, if you’re interested in a €300,000 resale property in Catalonia, the ITP alone would be €30,000, which is no small sum. Therefore, when you’re looking at properties, it’s wise to be mentally prepared for paying property taxes in Spain and add roughly 10% on top of the list price to estimate the total amount you’ll need.
