When buying property in Spain, you’ll mainly interact with two types of professionals: real estate agents and lawyers. Their roles and loyalties are completely different. The agent is hired by the seller, and their main goal is to close the deal to earn a commission. In contrast, the lawyer is hired by you, and their sole objective is to protect your interests. It’s crucial not to confuse the two! You can rely on an agent to find a property, but you must rely on your own lawyer for due diligence.

Therefore, regarding a notarized power of attorney, the correct process should be: after finding a property you like, either through an agent or on your own, you should immediately find a trustworthy, independent lawyer. Your lawyer will help you check if the property has any debts, illegal constructions, or other issues; draft the reservation contract and the final purchase deed; and represent you at the notary’s office for the signing. If you are not physically in Spain, you can also use a Power of Attorney for buying property in Spain (also known as a Poder) to grant your lawyer full authority to complete all steps on your behalf, such as applying for an NIE number, opening a bank account, and signing the title deed. This way, you can purchase property smoothly even from abroad.
