I’ve recently found an apartment I like near Madrid, but I’m short a few tens of thousands of euros for the down payment. A good friend in Germany heard about it and has generously offered to send me the money to help out. But this has put me in a difficult position, as it’s not a small amount. My main concern is how Spanish banks and the tax agency (Hacienda) will view this money. If tens of thousands of euros suddenly appear in my account, will the bank freeze it and ask me to provide all sorts of proof of source of funds when borrowing from a friend for a property purchase? It seems that large transfers are treated very cautiously here in Spain.

I’ve done some research online, and it seems there are two main ways to handle this: as a ‘loan’ or as a ‘gift’. The tax implications for each appear to be vastly different. If it’s a gift, it seems I would have to pay a substantial gift tax, depending on the regulations of my autonomous community. However, an interest-free loan between friends can apparently be tax-exempt, but the paperwork needs to be meticulous to avoid the tax agency classifying it as a disguised gift.

It seems the ‘loan’ route is the most cost-effective, but I still have many questions about the specific procedure. For instance, does the loan agreement need to be drafted by a lawyer, or is a standard online template sufficient? Does the contract need to specify repayment dates and methods? Most importantly, does it need to be notarized? Or is it enough to just submit the Modelo 600 form to the tax agency to be stamped?
I’d like to ask if anyone on the forum has had a similar experience. How did you handle it? Did the bank give you any trouble? I want the entire process to be 100% legal and compliant, as I don’t want to leave any potential issues for the tax agency down the line.
