I just transferred the ownership of a small apartment to a family member, and the whole process took nearly two months of running around. When I was researching online, the information was scattered and lacked detail. Now that I have some time, I’ve put together a complete breakdown of the process and costs to help anyone else in a similar situation.

In Spain, changing a property’s ownership typically falls into two categories: a sale and a donation/inheritance. The cost structures for these two methods are completely different, so it’s crucial not to mix them up. My case was a donation, but I also inquired about the costs for a sale. I’ve laid it all out in the table below for clarity.
Breakdown of the Main Costs
1. Notary Fees (Notaría)
This is a mandatory expense when adding a name to a property title. Whether it’s a sale or a donation, you must sign a public deed (escritura pública) before a notary. The fees are regulated by the state but can fluctuate based on the property’s value, the number of pages in the document, and its complexity. For my small apartment, the notary fees were around 700 euros.
2. Land Registry Fees (Registro de la Propiedad)
Signing the deed isn’t the final step. You then need to take the new deed to the Land Registry to register the new owner, which legally completes the transfer. This fee is also tied to the property’s value and is generally a bit cheaper than the notary fees. I paid about 500 euros for this.
3. Taxes (Impuestos)
This is the biggest and most complicated part of the expenses
! The type of tax and the rates vary dramatically depending on the situation.
| Transaction Type | Main Tax | Taxpayer | Reference Tax Rate |
| Property Sale | ITP or IVA | Buyer | ITP: 6%-10% / IVA: 10% |
| Property Donation | ISD | Recipient | Varies greatly based on family relationship and regional policies |
| Municipal Capital Gains Tax | Plusvalía Municipal | Seller or Donor | Calculated based on years of ownership and land value |
Take the donation tax (ISD)
for example. Direct relatives often benefit from very high allowances in many autonomous communities, potentially resulting in little to no tax. However, if changing a property name involves a donation between friends, the tax rate can be shockingly high. Therefore, before deciding on the method for a property transfer, it’s crucial to consult a professional tax advisor to calculate the costs. Otherwise, you could end up overpaying by a lot. Don’t try to save on the consultation fee—it could mean a difference of thousands or even tens of thousands of euros later on!
