Spain’s Digital Nomad Residency: A New Gateway for Global Remote Talent
In response to the global trend of remote work, the Spanish government has introduced a residence permit for international remote work (Teletrabajo de carácter internacional), also known as the “Digital Nomad Residency,” under the framework of the ‘Startup Act’ (Law 14/2013). This initiative creates a clear legal pathway for non-EU professionals who wish to live in Spain while working for companies not registered in Spain.
Core Applicant Qualifications
Applicants must be “qualified professionals,” proving their expertise in one of the following ways:
- Holding a university undergraduate or postgraduate degree, or having a background in accredited vocational training or business school programs.
- Demonstrating at least three years of relevant professional experience.
Furthermore, applicants can be employees or self-employed. As an employee, their employment relationship must be exclusively with companies outside of Spain. As a self-employed professional, income from services provided to clients within Spain cannot exceed 20% of their total income.
Key Application Requirements
According to Article 74 ter of the regulation, applying for this residence permit requires meeting several key criteria:
- Business History: The foreign company for which the applicant works, or the entity with which they have a business relationship, must have been established and operational for at least one year.
- Relationship Duration: The applicant must be able to prove a stable employment or business relationship with the company for at least three months prior to the application.
- Remote Work Authorization: An official document from the company must be provided, permitting remote work and detailing the job responsibilities, methods, and required tools.
- Financial Capacity: Proof of sufficient income to support their life in Spain is required, typically amounting to 200% or more of Spain’s minimum wage (SMI).
- Compliance: The applicant must have entered and be staying in Spain legally, have no criminal record, and hold valid health insurance.
Two Application Paths and Residency Periods
Spain offers two application methods for digital nomads, both from within and outside the country:
- Application from Abroad (Digital Nomad Visa): Applicants can apply at a Spanish consulate outside of Spain, for a “Digital Nomad Visa” with a maximum validity of 1 year. This visa allows legal residence and work in Spain. Within 60 days before the visa expires, holders can directly apply for a 3-year residence permit from within Spain.
- Application from within Spain (Digital Nomad Residency): Applicants who have already legally entered and are staying in Spain can apply directly to the Large Business and Strategic Collectives Unit (UGE-CE) for a residence permit, which is initially granted for a maximum period of 3 years. Afterwards, as long as the conditions are still met, it can be renewed for a period of 2 years.
Family and Tax Benefits
The policy is very favorable for family applicants. The main applicant’s spouse and minor children can apply simultaneously as dependents and obtain residency, and dependents are permitted to work in Spain. More attractively, eligible digital nomads can apply for the “Beckham Law,” enjoying a special non-resident personal income tax rate, which provides significant tax advantages. After 5 years, this policy offers the possibility for applicants to transition to long-term residency (permanent residency) in Spain.
