New Temporary Rental Regulations in Spain: Tenants Can Enforce a Two-Year Extension
The Spanish government passed Royal Decree-Law 8/2026 (Real Decreto-ley 8/2026) on March 20, 2026, which officially came into effect on March 22. This decree provides a significant temporary protection measure for tenants, allowing those who meet specific criteria to apply for a contract extension of up to two years, while also capping rent increases.
Eligibility and Core Rights
According to Valeria Racu, spokesperson for the Madrid Tenants’ Union, the key provisions of this decree apply to tenants whose current rental contracts expire between March 22, 2026, and December 31, 2027. Eligible tenants have the right to unilaterally request from their landlord an “extraordinary extension” (prórroga extraordinaria) of the lease for a period of two years.
During this two-year extension, the landlord’s annual rent adjustment cannot exceed a cap of 2%. This measure is intended to bring stability to the rental market and alleviate the pressure of rising rents on tenants.
Tenants Must Actively Apply; Not an Automatic Right
The right to renewal granted by this decree is not automatic; tenants must proactively submit a written request to their landlord. Legal professionals emphasize that tenants should act quickly, as this Royal Decree-Law could potentially be overturned by a vote in Congress (expected as early as late April 2026).
Legal expert Alejandra Jacinto points out that even if the decree is repealed in the future, renewal requests sent while it is still in effect (i.e., before its repeal) will remain legally valid. Therefore, sending the request before the decree potentially expires is a crucial step in protecting one’s rights.
How to Apply Effectively to Protect Your Rights
To ensure the legal validity of the application, it is not recommended to communicate via phone or instant messaging apps. Legal experts recommend using two methods highly recognized by the Spanish judicial system:
- Burofax: A certified document sent via the Spanish Post Office (Correos). It provides legally admissible proof of both the content and its delivery, making it the most robust form of communication.
- Certified Email (Email Certificado): An email service that provides legal evidence of communication and is also increasingly accepted by the courts.
Lawyers stress that once a tenant sends the request through these valid methods, the extension takes effect immediately, without needing to wait for the landlord’s consent or reply. Below is an application template provided by legal experts. Tenants only need to replace the information in brackets with their personal details:

Differing Views and Legal Outlook
While the legal team at the Tenants’ Union is confident in defending tenants’ rights in court, there are dissenting opinions in the industry. For example, the Association of Real Estate Agents (ANA) expresses reservations, suggesting that if the decree is repealed, only tenants whose contracts had already expired before the repeal might ultimately benefit from this right.
However, the prevailing legal opinion is that tenants should seize this current legal window of opportunity. By sending a formal request while the decree is valid, they secure the right to stable and rent-controlled housing for the next two years. Even if legal disputes arise later, they will have already established a strong legal basis.
