Repeated Misdiagnosis of Breathing Difficulties
It is understood that the man involved had frequently sought medical attention for persistent breathing difficulties years ago, but local public healthcare institutions did not pay sufficient attention. During multiple visits, clinicians misdiagnosed his symptoms as Chronic Obstructive Pulmonary Disease (COPD) or simple lower back pain. During this period, the patient’s true condition remained undetected, planting the seeds for a rapid deterioration in his health later on.
Departmental Communication Breakdown Leads to Shelved CT Report
In the following April, the local public hospital arranged a chest CT scan for the patient. However, due to a severe administrative coordination failure between the radiology and respiratory departments within the hospital, this crucial medical imaging report was left pending in the system for a long time after being uploaded. For up to six months, no medical staff accessed or evaluated this CT report.
During the months the report was forgotten, the patient’s condition continued to worsen. He went to the emergency department multiple times complaining of severe pain in his left arm, making it difficult to lift. However, emergency doctors failed to investigate the root cause, treating it merely as a torn tendon or common back pain.
Missed Window for Optimal Surgery and Court Ruling
It was not until October of the same year, when a doctor reviewed the patient’s historical medical records, that the CT report, which had been dormant in the system for half a year, was accidentally discovered. By this time, the imaging characteristics already showed an extremely obvious lung mass and enlarged lymph nodes. Further full-body examinations confirmed that the patient’s tumor had spread extensively, progressing to stage IV lung cancer accompanied by bone metastasis. Due to the delay of a precious 7 months, the patient completely lost the optimal window for early surgical resection and can currently only rely on chemotherapy to sustain his life.
In response to this incident, the Legal Consultative Council of the Valencian Community intervened to investigate and determined that the administrative and procedural errors within the local healthcare system directly led to the patient’s “loss of opportunity for treatment and prognosis.” The committee pointed out in the review report that medical staff failed to strictly fulfill their professional duties during the diagnosis and treatment process, and the negative impact of the delayed diagnosis on the prognosis was indisputable. Ultimately, the local court ruled, ordering the relevant health department to pay the patient €17,300 in medical negligence compensation.
