Policy Definition and Basic Application Thresholds
Under the Spanish immigration legal framework, the family social arraigo (Autorización residencia temporal por circunstancias excepcionales: Arraigo social) is a special residency permit designed for foreign nationals without legal status. Unlike the standard employment-based social arraigo, this pathway exempts the obligation to provide an employment contract, requiring instead that applicants prove they have the financial means to support themselves in Spain, either independently or through an immediate family member.
According to relevant regulations, applicants must meet several prerequisites: First, they must have lived continuously in Spain for at least two years (with no single departure exceeding 90 days within the two years prior to submission); secondly, they must have no criminal record in Spain or in their country of origin; finally, they must deeply integrate into the local society and obtain an integration report through relevant assessments. It is particularly important to note that once this type of residency is approved, the cardholder is legally prohibited from working as an employee or starting a business in Spain.
Core Application Document Checklist
To ensure a smooth submission process, applicants must submit a complete set of standardized documents to the regional Spanish immigration offices (Oficina de Extranjería):

- Official Application Form: Complete and sign the official EX-10 form.
- Proof of Identity: A complete copy of a passport with a validity of no less than 4 months.
- Proof of Residence Time: Primarily based on the municipal registration (Empadronamiento), supplemented by medical records, bank remittance statements, or educational institution certificates to build a chain of evidence for continuous residence (Note: some document evaluation standards require covering three years).
- Notarized No Criminal Record: A certificate of no criminal record issued by the country of origin and processed through dual authentication procedures.
- Integration Report: This document plays a decisive role and must explicitly state that the applicant is suitable for the “family social arraigo” category.
- Administrative Fee Payment Voucher: Completion of the TASA 790-052 administrative fee payment.
Review Standards for Proof of Financial Capacity
Financial proof is the core of the family social arraigo approval. If the applicant has an independent source of income, they can submit bank deposit balances, property deeds, financial investment products (such as stocks, funds, dividends), rental income, or pension certificates from their country of origin.
Given that most undocumented individuals lack legal income, the immigration office allows the submission of financial documents from immediate family members (spouse, parents, or siblings) as a guarantee. Guarantor documents can include employment contracts, payslips, personal income tax returns, or corporate quarterly tax vouchers. In official practical operations, if there is no clear family relationship between the guarantor and the applicant, the approval rate will generally drop significantly due to suspected inappropriate transfer of interests.
Processing Flow and Online Status Tracking
The submission procedure operates on a dual-track system: offline and online. Applicants can book an appointment through the official government website and personally submit materials to the immigration office in their jurisdiction; applicants holding a valid digital certificate can currently also upload and submit directly through the online system in some regions.
After entering the approval phase, applicants can use the online tracking system on the official Spanish immigration website to track progress. By simply entering their residency number (NIE) or case file number, combined with the submission date and the applicant’s birth year, real-time status can be obtained. The common statuses returned by the system mainly include six categories: “Processing”, “Approved”, “Rejected”, “Archived”, “Under Appeal”, and “Not Found”. After receiving the approval notification, the applicant must strictly proceed to the designated police station within one month to complete the fingerprinting and physical residency card issuance procedures.
