Incident Recap: The Fatal Confrontation at Playa de San Juan
The tragedy unfolded around 5:30 AM on August 13 at the TRAM station near the golf course in Alicante’s Playa de San Juan. According to the initial investigation, the 27-year-old victim, Miguel, and the 22-year-old suspect, who had met earlier that night in a nearby leisure area, got into an argument at the station. During the altercation, the suspect allegedly kicked Miguel forcefully in the head, causing him to fall and hit the tracks, which resulted in a severe traumatic brain injury.
After the Emergency Medical Coordination Center (CICU) received the alert, a SAMU mobile intensive care unit team successfully performed CPR on Miguel at the scene. He was then rushed to the Intensive Care Unit (ICU) at Alicante’s Dr. Balmis General University Hospital, but ultimately succumbed to his injuries.
Legal Proceedings: Suspect’s Release Sparks Controversy, Prosecution Appeals
The case was initially investigated as a homicide. The suspect was provisionally released after a court appearance last weekend, a decision that sparked controversy. The Prosecutor’s Office has swiftly appealed to the Provincial Court, seeking to overturn the release order and have the suspect remanded in custody.
Furthermore, the victim’s family has applied to the court to participate in the proceedings as a private prosecution. Some LGBTQ+ groups are also expected to exercise their right to popular action to intervene in the case’s subsequent hearings.
Investigation Focus: Homophobic Motive Sparks Widespread Debate
The core controversy of the case lies in the motive for the attack. The case gained wider attention after LGBTQ+ organizations like ‘Alicante Entiende’ alleged it was a homophobic attack, claiming it was triggered by the victim attempting to flirt with the assailant. The Spanish Ministry of Equality (Ministerio de Igualdad) has also written to the prosecutor’s office, requesting an assessment of whether the aggravating circumstance of discrimination under Article 22.4 of the Penal Code applies.
As a result, the Alicante Prosecutor’s Office for Hate Crimes has now taken full charge of the case, with the investigation focusing on the possible existence of a homophobic motive. However, the suspect’s defense lawyer, José Manuel Yepes, has strongly refuted this claim, stating that his client is also a member of the LGBTQ+ community and has experienced bullying due to his sexual orientation, thus lacking a homophobic motive. Other LGBTQ+ organizations have urged the public to remain calm and await the official investigation results.
