The Spanish government has announced that the new General Traffic Regulations will officially take effect on October 1st of this year. The core of this legislative update is to enhance the protection of vulnerable groups in road traffic by introducing a series of detailed rules and mandatory safety standards, aiming to comprehensively improve road safety levels in Spain.
First-ever Definition of ‘Vulnerable Road Users’
The new regulations introduce and clearly define the legal concept of ‘vulnerable road users’ (usuarios vulnerables de la vía) for the first time. This definition includes groups who face a higher risk of injury in traffic accidents due to their mode of transport (such as pedestrians and cyclists), age, or physical condition. This provides a solid legal basis for developing differentiated traffic management policies and improving safety for specific groups in the future.
Upgraded Safety Standards for Personal Mobility Vehicles (VMPs) and Bicycles
For light personal mobility vehicles (VMPs), such as e-scooters, the new rules establish a uniform minimum driving age of 15. Furthermore, the regulations mandate that riders must wear a safety helmet and a reflective vest at night, during bad weather, or in any low-visibility conditions to enhance their visibility and prevent accidents.
For cyclists, the new rules also tighten safety requirements, eliminating previous exemptions for not wearing a helmet in certain situations. This aims to reduce the risk of injury and death in cycling accidents through mandatory regulations.
New Dress Code and Traffic Rules for Motorcyclists
The regulations for motorcyclists have been significantly strengthened. The new rules specify that riders must wear closed-toe footwear on all roads, strictly prohibiting the use of flip-flops or sandals. When riding on interurban roads, protective gloves are also mandatory. Violating these dress code requirements will be considered a serious traffic offense, punishable by a fine of up to €200.
Adjustments have also been made to traffic rules:
- Congested Roads: Where clearly signposted, motorcycles are permitted to use the right shoulder, but their speed must not exceed 30 km/h.
- Passing Stationary Vehicles: When passing vehicles that are stopped due to an accident, breakdown, or traffic control, motorcycles must maintain a lateral safety distance of at least 1.5 meters and reduce their speed to at least 20 km/h below the road’s speed limit.
- Adverse Weather: In the event of road closures due to snowfall, all vehicles are prohibited from overtaking and must keep to the right to ensure the left lane remains clear for emergency vehicles.
Mandatory Protection for Professional Riders, with Fines up to €200
For professional riders, such as those in food delivery services, the new rules establish specific mandatory standards. These riders are required to wear a safety helmet and a reflective vest at all times during work, day or night, with no exceptions. Any violation of this rule will be classified as a serious traffic offense, subject to a fine of up to €200.
