Recently, our company needed to amend trademark information, and after spending some time navigating the process here in Madrid, I’ve accumulated some experience I’d like to share with everyone. I hope this can help those with similar needs.
When You Need to Process a Trademark Amendment
Trademark amendments mainly cover several situations: company name changes, address relocation, legal representative replacement, trademark design adjustments, etc. In my case, I dealt with a company relocation that required updating the trademark registration address. Important note: trademark amendment and trademark transfer are two different things—amendment refers to modifications of the trademark registrant’s basic information, while transfer refers to the change of trademark ownership.
According to the Spanish Patent and Trademark Office (OEPM) regulations, any changes to trademark registration information must be reported to the official authorities within 3 months. Failure to process this promptly may affect the trademark’s legal validity and could even put you at a disadvantage in infringement disputes.
Processing Procedure and Required Materials
The entire amendment process takes approximately 2-4 months. First, you need to prepare the relevant documents, including the amendment application form, business license copy, trademark registration certificate copy, amendment proof documents, etc. All non-Spanish documents require officially certified translation.

You can choose to submit your application online or in person. Submitting online through OEPM’s official website electronic system is more convenient, though you’ll need to register for a digital certificate first. For in-person submission, you go directly to the Patent and Trademark Office service center in Madrid to submit paper materials. I personally recommend the online method—you can track progress in real-time, and post-pandemic, the wait times for in-person queuing are really long.
Fee Structure Comparison
Different amendment types have different fees. Here’s a simple comparison table for reference:

If you’re amending multiple pieces of information at once, including updates for Madrid brand clothing, the fees will increase accordingly. At the time, I only processed an address amendment and prepared the materials myself for submission, spending less than €70 in total. If you hire an agency to handle Madrid brand matters, while it saves hassle, the costs will double.
Several Practical Suggestions
First, prepare scanned copies and translations of all materials in advance to avoid delays from having to repeatedly submit supplementary materials due to incomplete documentation. OEPM has strict requirements for file formats—PDF format is the safest bet.
Second, if your situation is similar to El Corte Inglés and involves multiple trademarks or multiple categories, consider batch application, which can save some fees. However, note that the amendment circumstances for each trademark must be identical; otherwise, they still need to be processed separately.
Third, during the amendment period, the trademark remains valid and doesn’t affect normal use. However, do not conduct trademark transfers or licensing before the amendment is completed, as this can easily lead to legal disputes.
Finally, I’d like to remind everyone that after the trademark amendment is completed, you’ll receive new certification documents. Remember to update the trademark information in your company’s internal files and external promotional materials.
