I’ve been so angry lately I can’t sleep, so I’m posting here to vent and ask for your advice. Here’s what happened: my son attends a decent private school in Madrid and is in Primaria. Last week during P.E. class, he was chasing a classmate, got tripped by another child, and hit his forehead on the edge of a planter. It started bleeding immediately.

After the incident, the teacher just rinsed it with some water, put a band-aid on it, and then called to inform me, saying it was just un pequeño rasguño (a small scratch) and that I could just pick him up after school. I was at work, and although a bit worried, I didn’t rush over because the teacher made it sound so minor. But when I picked him up in the afternoon, I was furious
! The wound hadn’t been cleaned properly, it was still oozing blood, and the area around it was swollen. That was no small scratch! I immediately took him to Urgencias (the ER)
, where the doctor said it was a laceration that needed stitches and that delayed treatment could lead to a risk of infection. Now my son has a scar on his forehead. Even though the doctor says it will fade over time, as a mother, my heart just aches.
My Communication with the School
The next day, I went straight to the school’s dirección (management) to demand an explanation. At first, their attitude was polite, but they kept emphasizing that it was an accident that happened while the children were playing, that the child who tripped my son didn’t do it on purpose, and that the school had fulfilled its duty of supervision. Regarding the teacher’s improper handling of the injury, they just brushed it off, saying the teacher was ‘perhaps inexperienced’ and that they would give an ‘internal reminder.’ There was no formal apology throughout the entire conversation, let alone any mention of compensating for the medical expenses. This attitude is truly disheartening. We pay substantial tuition fees, and this is the kind of service we get? It feels like they just want to sweep the issue under the rug. I feel so helpless. Do I just have to accept this and move on?
What Can We as Parents Do?
I consulted a lawyer friend and did some research online, and I’ve compiled a list of steps we as parents can take. I’m sharing it here in case anyone finds themselves in a similar situation.
| Step | Action | Notes |
| 1. Collect Evidence | Hospital’s medical report, photos of the injury, email records of communication with the school. | This is the essential material for any future negotiations or complaints. |
| 2. Formal Written Complaint | Submit a formal written complaint to the school, detailing the incident at this private school in Spain and your demands. | This is an official channel, and the school must respond within a specified time frame. |
| 3. Seek Legal Aid | If the school ignores the complaint or the resolution is unsatisfactory, consult a lawyer to see if it constitutes civil liability. | Schools have civil liability insurance, and you can file a claim through legal channels. |
| 4. Complain to the Education Department | Report the situation to the education department of your autonomous community. | While the process can be lengthy, it’s another way to apply pressure. |
I wonder if any parents on this forum have experienced something similar? How did you resolve it? Did you fight the school to the end, or did you eventually let it go? I’m still hesitating about whether to take legal action, mainly because I’m worried it will be a draining process and might affect my child’s environment at school. But when I think of the school’s attitude of shirking responsibility, I get furious. Ugh, I’d really appreciate any advice!
